Residence permit in Ukraine

Foreign citizens or stateless persons who come to Ukraine for a period of more than 90 days, must obtain an official residence permit in the country. The document confirming the right to temporary or permanent residence in Ukraine is a special permit in the form of a plastic card with a chip. To obtain a residence permit in Ukraine the grounds provided by law are required.

When obtaining a residence permit, it is necessary to take into account the nuances, non-compliance with which can be the basis for the refusal of the State Migration Service of Ukraine to issue a permit. In this regard, foreigners often have questions, the answers to which are presented below.

For how long is it necessary to apply for an exchange (extension) or a temporary residence permit?

If for some reason you need to exchange (extend) the previously obtained temporary residence permit in Ukraine, the documents shall be submitted no later than 15 working days before the end of the stay or validity of the residence permit. Violation of the terms is a valid reason for refusal in exchange (extension) of the permit.

What if you do not have time to submit documents for the exchange (extension) of a temporary residence permit on time?

If you do not have time to apply for an exchange (extension), you must withdraw from the place of registration (check out), pass a residence permit and re-obtain it. The law does not limit the number of such exchanges (extensions) of permits.

What should be done after the expiry of the temporary residence permit?

After the expiration of the temporary residence permit you need to withdraw from the place of registration (check out) and pass a residence permit in the State Migration Service of Ukraine at the place of issue. This formal procedure will ensure that you cross the border without hindrance when returning home. The information is recorded in the database of the SMS and taken into account when re-contacting the service.

How can I get a temporary residence permit?

There are three main grounds for obtaining a residence permit:

  1. Marriage to a citizen of Ukraine;
  2. Official employment in Ukraine with a work permit;
  3. The Intention to start a business in Ukraine.

In the case of marriage, a residence permit is issued for a period of one year. In other cases - prior to the termination of the employment relationship.

Why do I need an insurance if I already have insurance in the native country?

Insurance for the migration service is a special insurance, which includes not only medical care, but also compensation of capital investments in case of deportation. The reason for the deportation can be a ridiculous accident, including violation of the terms of extension of residence permit. Migration insurance is a guarantee of compensation for possible losses of invested capital or lost profits.

Can you apply for a temporary residence permit without my presence?

Unfortunately, this is not possible. According to the decree of the Cabinet of Ministers of Ukraine No. 322 as of 2018, a foreigner submits documents only in person. This is due to the fact that at the time of submission of documents a foreigner is photographed, fingerprinted and all information is entered into a single database.

If a permit is issued on the basis of family reunification, should the wife be present when applying for a residence permit?

Yes. During the submission of the documents a spouse must be present, as by law she is a host party in Ukraine. She confirms with her signature the consent to your stay in Ukraine. Therefore, without her presence it is impossible to apply for a residence permit.

Can I apply for an exchange (extension) of a temporary residence permit in Kyiv, if I received a residence permit in another city?

The law clearly states that the documents for the exchange (extension) of a temporary residence permit shall be submitted to the migration service at the place of registration. It follows that if you have a residence permit in Kyiv, you can easily apply in Kyiv! There are no other interpretations of the law in Ukraine.

Can I get a residence permit on the basis of marriage for three years?

Unfortunately, according to our legislation, you can get a residence permit on the basis of marriage only for one year! You will have to exchange (renew) your temporary residence permit annually.

For how long can I get a residence permit on the basis of employment?

On the basis of employment, you can get a residence permit for the period specified in the work permit. Based on this, we can say that the work permit for ordinary employees is issued for a period of up to 1 year. And for a founder - up to three years. You will receive a document for a residence permit for the same period of time.
